A builder’s remedy lawsuit allows the builder to force a community into allowing the builder to build whatever they want, not the other way around. These developments were coming no matter what. Those lots were never going to sit empty just because no one wants them. Show me one previous development where the builder had to improve the infrastructure? It doesn’t happen, because they’re not required to.
Belmar avoided their obligations for years, over MULTIPLE ADMINISTRATIONS. Working with the state is the only way to avoid being sued FOUR TIMES OVER by builders who want that high density. This is the way to retain some control over that.
